General Terms and Conditions of Travel for the organization of package tours pursuant to Section 651 a BGB and for the arrangement of package tours pursuant to Section 651 v BGB of Europa Discovery UG (haftungsbeschränkt), Königsallee 19, 40212 Düsseldorf Germany, Managing Directors: Ekaterina Prymichou, Georgiy Berber, e-mail: info@europa-discovery.de, telephone: + 49 (0) 211-97273521 (hereinafter referred to as "Europa Discovery")
- 1 GTC Scope of application
(1) These GTC apply between Europa Discovery and the travel customer (hereinafter referred to as "travel customer") upon conclusion of a package travel contract or the brokerage of package tours by Europa Discovery.
(2) Deviating general terms and conditions of the travel customer shall not be recognized unless Europa Discovery expressly agrees to their validity in writing.
(3) The GTC apply regardless of whether the travel customer is a consumer, entrepreneur or merchant. The travel customer is a consumer insofar as the purpose of the ordered goods and services cannot be predominantly attributed to his commercial or independent professional activity. In contrast, an entrepreneur is any natural or legal person or partnership with legal capacity that is acting in the exercise of its commercial or independent professional activity when concluding the contract.
(4) Amendments or supplements to these GTC must be made in writing and must be expressly identified as such. If the contracting parties have reached deviating agreements which have been recorded in writing, these shall take precedence over these GTC.
- 2. conclusion of contract and content of contract package travel contract/ arrangement of package travel contracts
- Europa Discovery as a tour operator
(1) The offers presented by Europa Discovery on the website www.europe-discovery.de do not constitute a binding contractual offer by Europa Discovery or the respective tour operator. By entering his/her data and submitting the online booking form, the travel customer makes a binding offer to Europa Discovery to conclude a package travel contract on the basis of the travel advertisement, the information on the relevant trip in the advertisement and the General Terms and Conditions of Travel. The travel customer will then receive a booking confirmation from Europa Discovery by e-mail at the e-mail address provided by the customer, which merely confirms receipt of the booking order to the customer. The travel customer is obliged to check the accuracy of the data in the booking confirmation for the desired travel service immediately upon receipt of the booking confirmation. The contract between the customer and Europa Discovery is only concluded when Europa Discovery has confirmed the requested services to the travel customer in a legally binding manner by sending a booking confirmation on a durable medium (e.g. by e-mail).
(2) If the content of the declaration of acceptance (travel confirmation) differs from the content of the booking, this constitutes a new offer from Europa Discovery, to which Europa Discovery is bound for a period of 10 days. The contract is concluded on the basis of this new offer if the travel customer declares acceptance within the binding period or commences the trip without objection.
(3) The travel customer shall be responsible for all contractual obligations of fellow travelers for whom he makes the travel registration, as well as for his own, provided that he has assumed this obligation by express and separate declaration.
(4) The nature and scope of the service to be provided by Europa Discovery is determined exclusively by the content of the travel confirmation in conjunction with the brochure/internet prospectus valid for the trip or the travel advertisement with all the information contained therein.
- Europa Discovery as a travel agent
(5) Europa Discovery expressly draws the travel customer's attention to the fact that travel contracts are not concluded with Europa Discovery but exclusively with the package tour operator specified in each case.
(6) Only a travel agency contract is concluded between Europa Discovery as travel agent and the travel customer. The object of this travel agency contract is the brokerage of package tours. The agreements on the brokerage of package tours apply exclusively to the brokerage activities of Europa Discovery and have no influence whatsoever on the conditions under which the brokered travel services are provided. The contractual conditions of the respective service provider are made available before the travel booking is made and must be explicitly confirmed by the travel customer.
(7) Paragraph 1 applies accordingly to the conclusion of an agency contract for a package tour via the website www.europe-discovery.de. Upon acceptance of the travel customer's brokerage order by Europa Discovery as travel agent, the contract for the brokerage of a package tour is concluded between the travel customer and Europa Discovery.
(8) The mutual rights and obligations of the travel customer and Europa Discovery as the travel agent shall, insofar as this does not conflict with any mandatory statutory provisions, arise from the contractual agreements made in the individual case, these Terms and Conditions and the statutory provisions, in particular Sections 651a et seq. Art. 250 et seq. EGBGB and §§ 675, 631 et seq. BGB on the provision of services against payment.
(9) The rights and obligations of the travel customer vis-à-vis the brokered tour operator shall be governed exclusively by the agreements made with the latter, in particular these GTC. The payment modalities for the payment of the travel price are based on the respective contractual provisions of the service provider of the booked package tour service.
- 3. general terms and conditions of payment
(1) A deposit of 20% of the tour price is due upon receipt of the travel confirmation with the security certificate. The remaining amount is due 4 weeks before the start of the tour and must be paid without being asked, provided that the security certificate has been handed over and it is certain that the tour will take place, in particular that it can no longer be canceled in accordance with § 7. (2) If the travel customer fails to pay the travel price due despite a reminder and a reasonable deadline for payment, Europa Discovery is entitled to withdraw from the contract and to charge the travel customer cancellation costs in accordance with § 6 paragraph 2.
(3) The above provisions apply to Europa Discovery as a tour operator and as a travel agent.

- Special regulations as a tour operator
- 4. general terms and conditions service changes
(1) Europa Discovery reserves the right to unilaterally change contractual conditions other than the tour price after conclusion of the contract if the changes are insignificant, do not affect the overall nature of the booked tour and are not brought about in bad faith (e.g. flight time changes of up to 4 hours, changes to the routing, route changes).
(2) The travel customer shall be informed of this on a durable medium (e.g. by email, text message) in a clear, comprehensible and prominent manner. The change is only effective if it meets these requirements and is declared before the start of the trip.
(3) Significant changes cannot be made without the consent of the travel customer; reference is made to the provisions of §§ 651f and g BGB.
- 5. general terms and conditions price increase, contract amendments
(1) Europa Discovery reserves the right to unilaterally increase the agreed tour price after conclusion of the contract if the increase in the tour price results directly from a) an increase in the price for the transportation of passengers due to higher costs for fuel or other energy sources, b) an increase in taxes and other charges for agreed tour services, such as tourist taxes, port or airport fees, or c) a change in the exchange rates applicable to the package tour in question. In the aforementioned cases, the travel price will be changed to the extent that the increase in the factors mentioned in a) to c) above affects the travel price per person.
(2) Europa Discovery shall inform the travel customer of the increase immediately on a durable medium. The price increase shall only be effective if it meets the aforementioned requirements and the travel customer is informed no later than 20 days before the start of the trip.
(3) The travel customer is entitled to a price reduction if the corresponding costs (paragraph 1) decrease or change and this leads to lower costs for Europa Discovery.
(4) Significant changes to the contract and a price increase of more than 8% are only permitted with the consent of the travel customer. Europa Discovery shall inform the travel customer of any changes to the contract, including the reasons, on a durable medium immediately after becoming aware of the reason for the change. Europa Discovery may require the travel customer to accept the offer of a significant contract amendment or price increase of more than 8% within a reasonable period of time specified by Europa Discovery or to withdraw from the contract. After expiry of the deadline set by Europa Discovery, the offer to significantly amend the contract or increase the price by more than 8% is deemed to have been accepted. Europa Discovery may also offer the travel customer the option of participating in a substitute tour with the offer of a significant contract amendment or price increase of more than 8%.
- 6 GTC Cancellation by the travel customer, trip interruption
(1) Travel customers may withdraw from the trip at any time before the start of the trip. The date of receipt of the declaration of withdrawal by Europa Discovery is decisive.
(2) If the travel customer withdraws from the package travel contract (cancellation) or does not commence the trip, Europa Discovery loses the right to the travel price, but may demand reasonable compensation. For this purpose, Europa Discovery has set the following flat-rate compensation amounts, which are determined as a percentage of the tour price depending on the time of the travel customer's withdrawal and the period between the declaration of withdrawal and the start of the tour, the expected saving of expenses by Europa Discovery and the expected acquisition through other use of the travel services:
- up to 30 days before departure 20 %;
- up to 21 days before departure 30 %;
- up to the 14th day before departure 50%;
- up to the 7th day before departure 60%;
- up to 1 day before departure 80%;
- 90% of the total price on the day of departure or in the event of non-arrival.
(3)
(4) Up until the start of the trip, the travel customer may request that a third party assume the rights and obligations arising from the package travel contract in his place. Europa Discovery may object to the entry of the third party if it does not meet the special travel requirements or if its participation conflicts with statutory provisions or official orders. In the event of a contract transfer, the original travel customer and the substitute participant are jointly and severally liable for the travel price and the additional costs incurred by the entry of the third party.
(5) It is recommended that you take out travel cancellation insurance and insurance to cover the costs of repatriation, accident, illness or death.
(6) If the travel customer does not make use of individual travel services duly offered by Europa Discovery due to premature return travel, illness or other reasons for which the travel customer is solely responsible, the travel customer shall not be entitled to a pro rata refund of the travel price.
- 7. withdrawal by Europa Discovery if the minimum number of participants is not reached
(1) Europa Discovery may withdraw from the contract due to the minimum number of participants not being reached if
- the minimum number of participants and the time by which the declaration must be received by the travel customer before the contractually agreed start of the trip are stated in the pre-contractual information and travel advertisement, and
- reference is made to this information in the travel confirmation.
(2) Cancellation by Europa Discovery must be declared to the travel customer no later than 4 weeks before the agreed start of the trip.
(3) Europa Discovery may also withdraw from the contract prior to the commencement of the contract if Europa Discovery is prevented from fulfilling the contract due to unavoidable, extraordinary circumstances. In this case, Europa Discovery must declare its withdrawal immediately after becoming aware of the reason for withdrawal. In the event of withdrawal, Europa Discovery loses the right to the agreed travel price. Payments made by the travel customer will be refunded within 14 days of the withdrawal at the latest.
- 8. general terms and conditions warranty
(1) If travel services are not provided by the tour operator in accordance with the contract, the travel customer is entitled to the statutory warranty rights. The travel customer is obliged to cooperate within the framework of the statutory provisions to avoid or minimize any damage in the event of service disruptions. In particular, the travel customer is obliged to inform the local tour guide, Europa Discovery or the travel agent immediately of any complaints.
(2) If the travel customer culpably fails to report a defect, there shall be no entitlement to a reduction in price or compensation if Europa Discovery was unable to provide a remedy due to the lack of notification of the defect. This shall only not apply if the notification is clearly futile or unreasonable for other reasons.
(3) If the trip is significantly impaired as a result of a defect, the travel customer may terminate the package travel contract in accordance with Section 651l BGB. However, termination of the package travel contract by the travel customer is only permissible if Europa Discovery does not provide a remedy after the travel customer has set a reasonable deadline for this. It is not necessary to set a deadline if the remedy is impossible, is refused by Europa Discovery or if the immediate termination is justified by a special interest of the travel customer.
(4) Warranty claims shall become time-barred after two years. The limitation period begins on the day on which the package tour should end according to the contract.
(5) The assignment of claims of the travel customer against Europa Discovery to third parties is excluded. This prohibition does not apply in the case of a family trip involving accompanying family members.
- GTC Passport, visa and health regulations
(1) Europa Discovery shall inform the travel customer prior to the conclusion of the contract about general passport and visa requirements of the destination country, including the approximate deadlines for obtaining visas and health formalities (e.g. vaccinations and certificates required by the police) that are necessary for the trip and the stay.
(2) The travel customer is responsible for complying with all passport, visa and health regulations that are important for the execution of the trip.
- 10. general terms and conditions obligation to provide information about airlines
(1) EU Regulation No. 2111/2005 on informing air passengers of the identity of the operating air carrier obliges Europa Discovery to inform the travel customer of the identity of the operating air carrier of all air transportation services to be provided as part of the booked trip at the time of booking.
(2) If the operating airline has not yet been determined at the time of booking, Europa Discovery is obliged to inform the travel customer of the airline that is likely to operate the flight and to ensure that travel customers are informed of the identity as soon as it has been determined. The same applies if the operating airline changes.

- Special regulations as a travel agent
- 11 GTC Obligations of the travel agent, information, notes
(1) The travel customer shall receive the best possible advice from Europa Discovery. At the customer's request, Europa Discovery will make a booking inquiry with the package tour operator. Once the package tour operator has confirmed this, Europa Discovery must provide the travel customer with the documents relating to the travel services arranged. This does not apply if it has been agreed that the package tour operator will send the documents directly to the travel customer.
(2) When providing other advice and information which Europa Discovery is not obliged to provide in accordance with Section 651v (1) BGB in conjunction with Art. 250 (1) to (3) EGBGB. Art. 250 § 1 to 3 EGBGB, Europa Discovery is liable as a travel agent within the framework of the law and the contractual agreements for the correct selection of the information sources and the correct forwarding to the travel customer.
(3) An information contract with a primary contractual obligation to provide information shall only come into existence if a corresponding express agreement has been made. Europa Discovery shall not be liable for the accuracy of information provided in accordance with Section 675 (2) BGB unless an information contract has been concluded.
(4) Europa Discovery is not obliged to determine and/or offer the most favorable provider of the requested travel service, unless this is expressly agreed.
(5) Contractual obligations of Europa Discovery within the scope of "best price guarantees" issued by it remain unaffected by this.
(6) Unless expressly agreed, Europa Discovery does not assume any guarantee within the meaning of Section 276 (1) sentence 1 BGB with regard to prices, services, booking conditions and other circumstances of the travel service and, with regard to information on the availability of the services to be arranged by the travel agent, no procurement guarantee within the meaning of this provision.
(7) Europa Discovery shall only accept special requests for forwarding to the package tour operator to be arranged. Unless expressly agreed otherwise, Europa Discovery is not responsible for the fulfillment of such special requests. These are also not a condition or contractual basis for the agency order or for the booking declaration of the travel customer to be forwarded by Europa Discovery to the package tour operator. The travel customer is advised that special requests generally only become part of the package tour operator's contractual obligations upon express confirmation by the package tour operator.
- 12. general terms and conditions Duty to provide information on entry requirements and visas
(1) If Europa Discovery undertakes the registration in electronic systems for the travel customer in return for payment or free of charge in order to obtain an entry permit as a prerequisite for entry or transit to certain countries, the following shall apply: The assumption of this activity shall not constitute any obligation on the part of Europa Discovery to make further inquiries or provide information on entry or transit formalities or on transit stops during the journey and in particular not to obtain visas without express agreement. The travel customer is advised that the electronic entry permit does not replace the final entry authorization by the border authorities of the respective country.
(2) Europa Discovery is not obliged to procure visas or other documents required for the execution of the trip without a special, express agreement. In the event that such an order is accepted, Europa Discovery may, without express agreement, demand reimbursement of the expenses it incurs which it may consider necessary in the circumstances. Europa Discovery may itself demand remuneration for its work if this has been agreed or if, under the circumstances, the work was only owed in return for corresponding remuneration.
(3) Europa Discovery shall not be liable for the issuance of visas and other documents or for their timely receipt. This shall not apply if the circumstances relevant to the non-issuance or delayed receipt were culpably caused or contributed to by Europa Discovery.
- 13. position and obligations of Europa Discovery in connection with air transportation services
(1) In accordance with EU Regulation No. 2111/2005 on the establishment of a Community list of air carriers, Europa Discovery is obliged to inform the passenger of the identity of the operating airline at the time of booking. (2) If the operating airline has not yet been determined at the time of booking, Europa Discovery will provide the travel customer with the information available from the airline that is likely to operate the flight. In the event of a change of airline, the travel customer will be informed of the change immediately.
(3) The Community list of airlines banned from flying in the European Union is available on the websites http://ec.europa.eu/transport/modes/air/safety/air-ban/index_de.htm and www.lba.de.
(4) The contractual relationship between the travel customer and the airline shall be governed by the statutory provisions of the German Air Traffic Act, the Warsaw and Montreal Conventions and directly by domestic statutory provisions, where applicable,

- 14. general terms and conditions documents
(1) Both the travel customer and Europa Discovery are obliged to check the contractual and other documents of the brokered package tour operator relating to the package tour that were handed over to the travel customer by Europa Discovery, in particular booking confirmations, flight tickets, hotel vouchers, visas, insurance certificates and other documents relating to the brokered package tour for accuracy and completeness, in particular for conformity with the booking and the brokerage order.
(2) Insofar as documents relating to the arranged package tour are not sent to the travel customer directly by the arranged package tour operator, they shall be handed over by Europa Discovery by electronic mail, unless the travel customer is entitled to a travel confirmation in paper form in accordance with Art. 250 § 6 Para. 1 Sentence 2 EGBGB.
- 15 GTC Obligations of the travel customer to cooperate
(1) The travel customer must notify Europa Discovery of any recognizable errors or deficiencies in Europa Discovery's brokerage activities as soon as they are discovered. This includes, in particular, incorrect or incomplete details of personal travel customer data, other information, information and documents about the arranged package tour as well as the incomplete execution of agency services (e.g. bookings or reservations not made).
(2) If no notification is made by the travel customer in accordance with § 15.1, the following shall apply:
- a) If the travel customer fails to notify us in accordance with § 15.1 through no fault of his own, his claims shall not lapse.
- b) Claims of the travel customer against Europa Discovery shall lapse insofar as the latter proves that the travel customer would not have incurred any damage or would not have incurred the amount claimed by the travel customer if proper notification had been made. This applies in particular if Europa Discovery proves that immediate notification by the travel customer would have enabled Europa Discovery to remedy the defect or reduce the damage, e.g. by rebooking, additional booking or canceling with the package tour operator.
- c) Claims of the travel customer in the event of failure to notify in accordance with § 15.1 shall not lapse
in the event of damages arising from injury to life, limb or health resulting from an intentional or negligent breach of duty by Europa Discovery, its legal representative or its vicarious agents
in the case of claims for compensation for other damages that are based on an intentional or grossly negligent breach of duty by Europa Discovery or a legal representative or vicarious agent of the travel agent
in the event of a breach of a material obligation, the fulfillment of which is essential for the proper execution of the agency contract or the breach of which jeopardizes the achievement of the purpose of the contract. Liability for booking errors in accordance with § 651x BGB remains unaffected.
(3) In his own interest, the travel customer is requested to inform Europa Discovery of any special
needs or restrictions with regard to the requested package tour.
- 16. general terms and conditions Obligations of the travel agent in the event of complaints by the travel customer against the package tour operators brokered
(1) Europa Discovery is deemed to be authorized by the tour operator to receive notifications of defects and other declarations from the travel customer regarding the provision of the package tour. Europa Discovery shall immediately inform the tour operator of such declarations by the traveler. The travel customer may therefore also notify Europa Discovery, through which it booked the package tour, of any complaints or other declarations regarding the provision of the travel services by the package tour operator.
(2) Europa Discovery is under no obligation to advise the travel customer on claims against the arranged package tour operators regarding the type, scope, amount, eligibility requirements and deadlines to be observed or other legal provisions.
(3) Europa Discovery recommends, in order to avoid loss of time despite immediate forwarding, that such declarations be made directly to the tour guide or the tour operator's contact point.
- 17. general terms and conditions notes on insurance
(1) Europa Discovery draws attention to the possibility of minimizing the cost risk of
Cancellations by the travel customer must be covered by travel cancellation insurance at the time of booking.
(2) The travel customer is further advised that travel cancellation insurance
usually does not cover the loss or damage that may arise if the traveler cancels the package tour after it has commenced, even if the traveler is not at fault. As a rule, travel interruption insurance must be taken out separately.
(3) Europa Discovery also recommends ensuring that you have adequate international health insurance cover when traveling abroad.
(4) When arranging travel insurance, the travel customer is informed that the
insurance conditions of the travel insurance brokered may contain special contractual conditions and/or obligations of the travel customer to cooperate, in particular exclusions of liability (e.g. in the case of pre-existing conditions), the obligation to cancel immediately in the case of travel cancellation insurance, deadlines for reporting claims and deductibles. Europa Discovery is not liable if it has not provided incorrect information regarding the insurance conditions and the travel insurer has a right to refuse to pay benefits to the travel customer on the basis of validly agreed insurance conditions.

Joint regulations as a tour operator and travel agent for package tours
- 18 GTC Liability
- Europa Discovery as a tour operator
(1) The contractual liability of Europa Discovery as tour operator for damages other than bodily injury is limited to three times the tour price, insofar as Europa Discovery is not culpably responsible for the damage.
(2) Excursions, transportation services, sporting activities and rental cars offered by the local tour guide or by other persons at the vacation destination and booked locally are not part of the package travel contract between the travel customer and Europa Discovery. Europa Discovery is not liable for this.
(3) A claim for damages against Europa Discovery as the tour operator is limited or excluded insofar as a claim for damages against the service provider only arises or can only be asserted under certain conditions or restrictions or is excluded under certain conditions due to international agreements or statutory provisions based on such agreements that are applicable to the services to be provided by a service provider. Reference is made to the statutory provisions of § 651p II BGB.
- Europa Discovery as a travel agent
(4) Insofar as Europa Discovery as a travel agent has not assumed a corresponding contractual obligation by express agreement with the travel customer, Europa Discovery shall not be liable for the realization of the travel customer's booking requests or for the conclusion of contracts with the travel companies to be brokered.
(5) Unless Europa Discovery has expressly assumed warranty and liability for the brokered services themselves, Europa Discovery shall not be liable for defects in the brokered trip or for personal injury or property damage incurred by the travel customer in connection with the brokered travel service. In this case, the liability agreed under paragraphs 1-3 refers exclusively to the liability arising from the agency contract.
- 19 Data protection
(1) The travel customer expressly agrees to the electronic data processing of his personal data within the framework of the following regulations. Travel customer data will be treated with absolute confidentiality. The data provided by the travel customer will be used exclusively for the professional execution of the service. The data will not be passed on to third parties.

- 20 European dispute resolution
(1) We draw your attention to the online dispute resolution pursuant to Art. 14 para. 1 ODR-VO: The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr. Here you can enter into an out-of-court settlement of consumer disputes arising from online contracts.
(2) We are not willing or obliged to participate in a dispute resolution procedure before a consumer arbitration board.
- 21 Means of payment for online bookings, due date
(1) All prices in our online store include the currently applicable VAT, if VAT is applicable.
(2) Payment is possible using the means of payment specified by Europa Discovery on the website.
- 22 Choice of law and place of jurisdiction
(1) The contract and the legal relationship between the travel customer and Europa Discovery shall be governed exclusively by German law.
(2) Insofar as German law is not applied in the event of legal action by the travel customer against Europa Discovery abroad for the reason for liability, German law shall apply exclusively with regard to the legal consequences, for example with regard to the nature, scope and amount of claims by the travel customer.
(3) The place of jurisdiction of Europa Discovery is its registered office in Düsseldorf.
(4) For legal action by Europa Discovery against the travel customer, the domicile of the travel customer shall be decisive, unless the action is directed against registered traders or persons who have no general place of jurisdiction in Germany, or against persons who have moved their domicile or habitual residence abroad after conclusion of the contract, or whose domicile or habitual residence is unknown at the time the action is brought. In these cases, Europa Discovery's registered office shall be decisive.
(5) The agreements shall not apply if non-modifiable provisions of international agreements applicable to the package travel contract between the travel customer and Europa Discovery provide otherwise for the benefit of the travel customer or if and to the extent that non-modifiable provisions applicable to the package travel contract in the EU Member State to which the travel customer belongs are more favorable to the travel customer than the provisions in these GTC or the applicable German regulations.

Participation in the competition of Europa Discovery, hereinafter referred to as the organizer, is free of charge and is governed exclusively by these conditions of participation. To take part in the competition, it is necessary to complete and submit the entry form. Participation is only possible within the participation period. Entries received after the closing date will not be considered in the draw.
Participation in the competition is possible from 01.08.23 at 00:00 until 01.10.23 at 00:00. During this period, users will have the opportunity to take part in the competition.
3. eligibility to participate
Natural persons who have reached the age of 18 are eligible to participate. Furthermore, a valid residence permit for the country in which the tour takes place is required. Participation is not restricted to customers of the organizer and is not dependent on the purchase of goods or services. If a participant has limited legal capacity, the consent of their legal representative is required.
All persons involved in the conception and implementation of the competition and employees of the organizer and affiliated companies as well as the relatives of such employees and their relatives are not eligible to participate in the competition. Participation with forged identities or with identities of third parties is not permitted.
Only one submitted registration per participant will be entered into the competition. It is strictly forbidden to use multiple addresses or profiles to increase the chances of winning. In addition, the organizer reserves the right to exclude persons from participation at its own discretion if there are justified reasons. Such reasons include, in particular
- Manipulation in connection with access to or execution of the competition
- Violations of these conditions of participation
- unfair trading
- false or misleading information in connection with participation in the competition.
If the excluded participant is a winner who has already been drawn, the prize may be subsequently revoked.
4. winnings, notification of winnings and transfer of winnings
We are giving away the following prizes among all eligible participants:
- An adventure tour through the Alps OR Croatia with our vehicles. The duration of the tour (3, 5 or 7 days depends on the tour itself and cannot be determined in advance) Travel is not included.

The winners will be determined within one week of the closing date in a random draw among all participants.
The participants who are winners of the prize draw will be informed of the prize in a separate e-mail in a timely manner. The prize will only be handed over to the participant who has won or to the legal representative of the legally incapacitated participant.
It is not possible to exchange, transfer, collect or pay out the prize in cash. Any costs incurred for shipping the prizes will be borne by the organizer.
The organizer is not responsible for delivery damage. Any additional costs associated with claiming the prize shall be borne by the participant who has won. The participant who has won is responsible for paying any taxes on the prize. If the participant who has won does not respond after two requests to do so within a period of 3 weeks, the claim to the prize shall lapse. In this case, the organizer is entitled to carry out a replacement draw and then transfer the prize to another participant.
Only one prize is possible per participant. If circumstances arise for which the organizer is not responsible, the respective participant who has won will accept an appropriate substitute prize. Such circumstances for which the organizer is not responsible are in particular those that lie with the sponsors of the prizes.
The profit achieved remains valid until the end of 2024.
5. termination of the competition
The organizer reserves the right to terminate the competition prematurely in whole or in part at any time, even without observing deadlines and without prior notice and without giving reasons, or to change its course if it is not possible for technical or legal reasons to guarantee the proper and scheduled execution of the competition.
6. data protection
Personal data (first and last name, e-mail address) must be provided in order to take part in the competition. The participant assures that the personal details provided by him/her, in particular first name, surname and e-mail address, are truthful and correct.
The organizer is responsible for the collection, processing and use of participants' personal data. The organizer will only use the participant's personal details and other personal data in accordance with the statutory provisions of data protection law. The organizer points out that none of the participant's personal data will be passed on to third parties or made available to them for use without consent.
The organizer will only store, process and use the information insofar as this is necessary for the implementation of the competition or if the participant has given their consent.
7. applicable
Law Questions and complaints in connection with the competition must be addressed to the organizer. The organizer's competition is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.
8. severability clause
Should any provision of these Terms and Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Terms and Conditions of Participation. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic meaning and purpose of the invalid provision. The same applies in the event of a loophole in these conditions of participation.
